3.2 Information Collected Automatically

When you visit the Website, certain technical information is collected automatically by our web server and analytics tools:

  • Device and Browser Information: Browser type and version, operating system, device type (desktop, mobile, tablet), screen resolution, and language settings.
  • Usage Data: Pages visited, time spent on each page, links clicked, referring website (where you came from before visiting our site), and exit pages.
  • IP Address: Your device’s Internet Protocol (IP) address, which may be used to determine your approximate geographic location (city and state level).
  • Cookie Data: Information stored in cookies and similar tracking technologies as described in Section 8.
  • Log Data: Server log files that record requests made to our website, including timestamps, URLs requested, and error codes.

Most of this automatically collected data is aggregated and does not directly identify you as an individual. However, IP addresses and certain cookie identifiers may constitute personal information under applicable law.

3.3 Information from Third Parties

We may occasionally receive information about you from third parties, including:

  • Referrals: When an existing client refers you to us, they may provide your name and contact information.
  • Business Partners: When we collaborate with other contractors, suppliers, or professionals on a project, they may share relevant contact information with us.
  • Public Sources: Publicly available property records, permit databases, or other public records may be reviewed in connection with a project assessment.
  • Analytics Providers: Third-party analytics platforms may provide aggregated or anonymized data about website usage patterns.

Section 4

How We Collect Information

We collect personal information through the following means:

4.1 Website Contact Forms and Inquiry Submissions

Our Website includes contact forms and estimate request forms that invite you to provide your name, contact information, property details, and service needs. Information submitted through these forms is transmitted to us and stored in our customer relationship and project management systems.

4.2 Direct Communications

When you contact us by phone, email, text message, or postal mail, we collect the information you provide and may retain records of those communications as part of your client file.

4.3 On-Site Consultations and Project Work

When we visit your property for a site assessment or to perform work, we may collect site photographs, property measurements, notes about site conditions, and other information necessary to plan and document the project. This information is retained as part of the project record.

4.4 Cookies and Automated Technologies

Like most websites, ours uses cookies and related technologies to collect certain information automatically when you visit. See Section 8 for a full description of how we use cookies and your options for managing them.

4.5 Third-Party Analytics Platforms

We may use third-party analytics services — such as Google Analytics — to understand how visitors use our Website. These services collect information about your use of our site on our behalf and provide us with aggregated reports. These providers have their own privacy policies governing the use of data they collect.

Section 5

How We Use Your Information

We use the personal information we collect for the following purposes. We collect only the information necessary for these stated purposes and do not use it in ways inconsistent with them:

5.1 Responding to Inquiries and Providing Estimates

The primary reason we collect contact and property information through the Website is to respond to your service inquiry, schedule a site consultation, prepare a project estimate or proposal, and communicate with you about your potential project. We use your contact information to reach you by phone, email, or other method you have indicated.

5.2 Delivering and Managing Services

For clients who engage us for a project, we use your personal and property information to plan and execute the work, manage project scheduling, obtain required permits on your behalf, coordinate with subcontractors and suppliers, invoice for services, process payments, and document the completed work. Your information is retained in our project management records throughout the lifecycle of the project.

5.3 Communications About Your Project or Inquiry

We use your contact information to send you information directly related to your inquiry or project — including scheduling confirmations, project updates, change order notices, permit status updates, invoice reminders, and project completion documentation. These communications are service-essential and are not marketing.

5.4 Marketing and Business Development

With your permission, or where permitted by applicable law, we may use your contact information to send you occasional information about C3 Scott Inc’s services, seasonal maintenance reminders, promotions, or other content we believe may be of interest to waterfront property owners. You may opt out of these communications at any time as described in Section 10.

5.5 Website Improvement and Analytics

Automatically collected usage data and analytics information help us understand how visitors use the Website, which pages are most visited, how users find us, and where the user experience can be improved. This analysis is conducted on aggregated and anonymized data where possible.

5.6 Legal Compliance and Business Protection

We may use personal information as necessary to comply with applicable federal, state, and local laws; respond to lawful requests from government authorities; enforce our Terms of Service or other agreements; protect the rights, property, and safety of C3 Scott Inc, our employees, clients, and the public; and pursue or defend legal claims.

5.7 Business Records and Documentation

We maintain project records, financial records, and communications records in accordance with applicable legal, tax, and business requirements. These records may contain personal information about clients and are retained for the periods described in Section 9.

Section 6

Legal Bases for Processing

For users in jurisdictions that require identification of a legal basis for personal data processing (including users protected by applicable U.S. state privacy laws or international frameworks), C3 Scott Inc relies on the following legal bases:

  • Contract Performance: Processing your information is necessary to fulfill our obligations under a service agreement with you, or to take steps at your request prior to entering into a contract (such as preparing a project estimate).
  • Legitimate Interests: We process certain information for our legitimate business interests, including operating and improving the Website, maintaining secure systems, communicating with prospective clients, and managing our business — where those interests are not overridden by your privacy rights.
  • Legal Compliance: Some processing is required for us to comply with applicable laws, including North Carolina contractor licensing requirements, tax obligations, and regulatory compliance in connection with permit applications.
  • Consent: Where we rely on your consent for a specific processing activity (such as sending marketing emails), you may withdraw that consent at any time without affecting the lawfulness of processing before the withdrawal.

Section 7

How We Share Your Information

Our commitment: We do not sell, rent, trade, or transfer your personal information to third parties for their own marketing or commercial purposes.

We may share your personal information in the limited circumstances described below:

7.1 Service Providers and Subcontractors

We may share your contact and project information with trusted third-party service providers and subcontractors who assist us in delivering our services or operating our business. These include:

  • Subcontractors: Specialty marine construction subcontractors engaged to perform specific components of your project (e.g., electrical marine work, lift equipment installation). We share only the information they need to perform their scope.
  • Material Suppliers: Suppliers who need your property address for delivery coordination.
  • Permit Agencies: Government agencies (CAMA, Army Corps of Engineers, NC DEQ, local permit offices) that require project and property information as part of the permitting process.
  • Technology Providers: Providers of our website hosting, email services, customer management software, accounting software, and analytics platforms. These providers access personal information only as necessary to provide their services to us and are bound by appropriate data processing agreements.
  • Payment Processors: Third-party payment processing services that handle payment card transactions securely. We do not store payment card numbers; they are handled directly by our payment processor in accordance with PCI DSS standards.

7.2 Legal and Regulatory Disclosures

We may disclose personal information when required by law, regulation, or valid legal process, including:

  • In response to a court order, subpoena, or other compulsory legal process;
  • To comply with applicable federal, state, or local laws;
  • In cooperation with regulatory or law enforcement investigations;
  • To protect the safety of any person from a threat to life; or
  • To protect the rights and property of C3 Scott Inc against fraud, theft, or other illegal activity.

Where permitted, we will make reasonable efforts to notify you of such disclosures before complying.

7.3 Business Transfers

In the event of a merger, acquisition, asset sale, or other business transfer involving C3 Scott Inc, personal information may be transferred as part of the transaction. See Section 16 for more information about how we handle this scenario.

7.4 With Your Consent

We may share your personal information for purposes not described in this Policy if we obtain your explicit consent to do so beforehand.

7.5 Aggregated and De-Identified Data

We may share aggregated or de-identified information — information that cannot reasonably be used to identify you — for business, marketing, or analytical purposes. This does not constitute sharing of personal information.

Section 8

Cookies & Tracking Technologies

8.1 What Are Cookies?

Cookies are small text files placed on your device by a website when you visit it. They allow the website to remember information about your visit and preferences. Cookies are widely used to make websites work more efficiently and to provide analytics information to website operators.

8.2 Types of Cookies We Use

Cookie Type Purpose Duration
Essential Cookies Required for basic website functionality — allowing contact forms to work, maintaining session state, and enabling security features. Cannot be disabled without affecting website operation. Session or up to 1 year
Analytics Cookies Help us understand how visitors use the Website — which pages are most visited, where traffic comes from, and how long visitors stay. We use this data in aggregate to improve the site. May include Google Analytics cookies. Up to 2 years
Preference Cookies Remember your choices and preferences (such as your preferred language or region) to improve your browsing experience on return visits. Up to 1 year
Marketing Cookies If used, these cookies track your online activity to help deliver more relevant advertising. We use these minimally and only for our own advertising purposes, not for third-party ad networks. Up to 1 year

8.3 Google Analytics

Our Website may use Google Analytics, a web analytics service provided by Google LLC. Google Analytics uses cookies to collect information about how visitors use our site. This information is transmitted to Google’s servers and used to compile reports on website activity for us. Google may also transfer this information to third parties where required by law or where those parties process the information on Google’s behalf.

You can prevent Google Analytics from collecting your data by installing the Google Analytics Opt-out Browser Add-on available at tools.google.com/dlpage/gaoptout. Google’s privacy policy is available at policies.google.com/privacy.

8.4 Managing Cookies

You can control and manage cookies through your web browser settings. Most browsers allow you to refuse new cookies, delete existing cookies, and set preferences for specific websites. Please note that disabling certain cookies may affect the functionality of the Website. Common browser cookie settings:

  • Firefox: Options → Privacy & Security → Cookies and Site Data
  • Safari: Preferences → Privacy → Manage Website Data
  • Edge: Settings → Cookies and site permissions → Cookies and site data

8.5 Do Not Track Signals

Some browsers offer a “Do Not Track” (DNT) setting that sends a signal to websites you visit indicating that you do not wish to be tracked. Our Website does not currently alter its data practices in response to DNT signals, as there is no established universal standard for interpreting them. We will revisit this position as industry standards develop.

Section 9

Data Retention

We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. When personal information is no longer needed, we delete or anonymize it in a secure manner.

10.2 Right to Correction

If the personal information we hold about you is inaccurate or incomplete, you have the right to request that we correct or update it. You may also update your contact information by notifying us directly.

10.3 Right to Deletion

You may request that we delete personal information we hold about you. We will honor deletion requests to the extent permitted by our legal obligations. We will inform you of any such limitations when we receive your request.

10.4 Right to Restrict Processing

In certain circumstances, you may request that we restrict our processing of your personal information — for example, while the accuracy of the information is being contested, or while a complaint is being investigated.

10.5 Right to Object to Marketing

You have the right to object to receiving marketing communications from us at any time, at no cost. You can exercise this right by:

  • Clicking the “unsubscribe” link in any marketing email we send;

10.7 Exercising Your Rights

To exercise any of these rights, contact us using the information in Section 19. We may need to verify your identity before fulfilling your request to protect against unauthorized disclosure of personal information. We will respond to verified requests within the timeframes required by applicable law, but in no event longer than forty-five (45) days for an initial response.

We will not discriminate against you for exercising any privacy right — we will not deny you services, charge you different prices, or provide different service quality as a result of your exercising a privacy right permitted by law.

10.8 North Carolina Residents

Residents of North Carolina may have additional rights under the North Carolina Identity Theft Protection Act and related statutes. If you believe your personal information has been compromised, or if you have specific questions about your rights under North Carolina law, please contact us directly.

You provide personal information to us at your own risk with respect to circumstances beyond our reasonable control.

11.3 Data Breach Notification

In the event of a data security breach that poses a risk of harm to individuals whose personal information has been compromised, C3 Scott Inc will comply with applicable North Carolina data breach notification requirements under N.C. If such a transfer occurs, we will use commercially reasonable efforts to notify clients whose personal information is included in the transfer, either through a notice on the Website or through direct communication. The successor entity’s privacy practices will govern any personal information transferred, and we will require, as a condition of the transaction, that the successor entity adopt reasonable privacy practices consistent with the commitments made in this Policy or notify affected individuals of any material changes.

We encourage you to review this Policy periodically to stay informed about how we protect your information.

Your continued use of the Website or engagement with our services after any update to this Policy constitutes your acceptance of the updated terms, to the extent permitted by applicable law.
